COVID mRNA ‘Vaccines’ Are Legally Not Vaccines — And You Cannot Be Legally Forced To Take Any Of Them

During a recent roundtable discussion entitled Focus On Fauci, Robert Kennedy Jr., Dr. Judy A Mikovitis, PhD, Rocco Galati, Sacha Stone, and Dr. David Martin delved into the long criminal history of the grossly unqualified “America’s Doctor,” Anthony Fauci.

During an excerpt of that discussion, which we have transcribed below, Dr. David Martin explains that these new mRNA so-called “vaccines” do not, in fact, qualify under the FDA’s own legal definition of a vaccine.

This is a crucially important issue because the government– and media legal pundits like Alan Dershowitz — have been invoking the 1905 Jacobson v Massachusetts case in which the U.S. Supreme court upheld that the States have the right to enforce compulsory vaccination laws.  If these mRNA “vaccines” are not legally vaccines — but rather medical devices — then the government has no legal right to force anyone to submit to them.

Dr. David Martin explains:

Let’s make sure we’re clear on something — let’s stipulate that this is not a vaccine.  We’re using the term “vaccine” to sneak this thing under public health exemptions.  This is not a vaccine.  This is an mRNA — packaged in a fat envelope — that is delivered to a cell.  It is a medical device designed to stimulate the human cell into becoming a pathogen creator.  It is not a vaccine — vaccines are actually a legally-defined term, and they’re legally defined term under public health law — they’re legally defined term under CDC and FDA standards.

And a vaccine — specifically — has to stimulate both an immunity in the person receiving it — but it also has to disrupt transmission.  And that is not what this is.  They have been abundantly clear in saying that the mRNA strand that is going into the cell is not to stop transmission.  It is a treatment.  But if it were discussed as a treatment, it would not get the sympathetic ear of public health authorities because then people would say, “What other treatments are there?”

The use of the term “vaccine” is unconscionable for both the legal definition of it, but also it is actually also the “sucker punch” to open and free discourse — because by saying “vaccine” you dump it into a thing where you can be anti- or pro- the therapy.  But if you actually talked about it as a therapy — remember — and people forget this — Moderna was started as a chemotherapy company for cancer — not a vaccine manufacturer for SARS.  If we said we were going to give people a prophylactic chemotherapy for the cancer they don’t have, you’d be laughed out of a room — because it’s a stupid idea.

That’s exactly what this is — this is a mechanical device in the form of a very small packet of technology that is being inserted into the human system and activate the cell to become a pathogen manufacturing site.  And I refuse to stipulate — in any conversations — that this is a “vaccine” issue.  The only reason why the term is being used is to abuse the 1905 Jacobson case that has been misrepresented since it was written.

And if we were honest with this, we would actually call it what it is — it is a chemical pathogen device that is actually meant to unleash a chemical pathogen production action within a cell.  It is a medical device — not a drug — because it meets the CDRH [FDA’s Center for Devices and Radiological Health] definition of a device.  It is not a living system — it is not a biologic system — it is a physical technology — it just happens to come in the size of a molecular package.

So we need to be really clear in making sure we don’t fall for their game — because their game is — if we talk about it as a “vaccine”, then we are going to get into a “vaccine” conservation — but this is not — by their own admission — a vaccine.  As a result, it must be clear to everyone listening that we will not fall for this failed definition — just like we won’t fall for their industrial-chemical definition of “health” — because both of them are functionally flawed and are an explicit violation of the legal construct that is being exploited….If you stipulate that it is a “vaccine”, you’ve already lost the battle….

80% of the people allegedly exposed to the virus have no symptoms at all — they are called “asymptomatic carriers”.  80% of the people who get this injected into them have a “clinical adverse event”.  You are getting injected with a chemical substance to induce illness — not to induce a immune-transmissive response.  In other words, nothing about this is going to stop you from transmitting anything.  This is about getting you sick — and having your own cells be the thing that get you sick.

  2. Now to start, the problem with this piece is who is featured in it. It’s important for everyone, including Christians, to consider sources of information and ask if they truly are reputable people? For instance, Dr. Judy A Mikovitis is a discredited researcher, who has made numerous false scientific claims, and she has even been arrested and jailed for felony. The first sentence of this article talks about the “long criminal history” of Dr Fauci, but it is ironic because Mikovitis has literally been arrested and been caught out for faking scientific data.

    • Of course Dr. Mikovits is “discredited”. Anyone who doesn’t go along with the “pandemic” narrative has been officially “discredited” in the controlled media. When she crossed Fauci, he and his attack dogs harassed her and had her arrested for “stealing” petty things like notebooks and such. You failed to mention in your slander of her that all charges were dropped against her. And just because Fauci has never been charged, arrested, or jailed does not mean he doesn’t have a long criminal history. Only a criminally minded psychopath would lead this fake pandemic and deceive the entire nation, or at least those, like yourself, who will fall for his b.s.

    • Not true, get your facts straight and not from ridiculous Snopes fact checkers who don’t even do their research properly. She was never charged and was arrested illegally. It wasn’t for false claims, they tried to frame her and said that she took intellectual property and There is absolutely no proof of that.

  5. A basic clarification about vaccine and biological products (of course you can do your own further research). The question: Is covid-19 “vaccine” a legal definition of vaccine and/or biological product?

    Just 3 days later, “March 26: Congress passes the CARES Act, which allots $9.5 billion for vaccine development.” (https://www.motherjones.com/kevin-drum/2020/11/operation-warp-speed-a-timeline/). According to this timeline, scientists were already developing a vaccine by January 11, 2020.
    If you were looking for a legal loophole, they already covered their tracks.
    Aside, this vaccine is still experimental since this does not have full efficacy and rigorous standards covered and tested. Emergency use only, not mandated or forced. Just say no. Carry on with your lives as best you can.
    Personally, I’m still waiting for public access and proof from the medical, government or media showing that covid is more than a yearly flu (as they tout it with fear-mongering), or that it has evolved into some magical deadly coronavirus. Coronaviruses always evolve, which is why any flu vaccine can prove to be ineffective (in the least) when the medical makes guessing games of what it might be in a year from now and then produce a vaccine for that guessed strain. So far, covid looks like a yearly flu with the same symptoms and death count. I haven’t had the flu in 50 years, so I don’t see a real problem for me as an elder. I do see a lot of fears and bad use of statistics and ineffective PCR testing, which is always a red-flag that lies usually follow. I’d also like to see a few real photos of the covid microorganism and compare it alongside real photos of exosomes (not these computer generated graphics). There is a total lack of transparency and explanations from the experts and mouthpieces on all of this. We can clearly see that much, so it encourages unverifiable rumors, more unanswered questions, MISTRUST, being told to shut up (censorship), and then treated like children to get in line and obey rules from self-appointed rulers of the medical “knowledge”. No thanks. I’m all grown up now. Speak honestly with full disclosure if you want me to choose rightly. If they are telling the truth, then that will be apparent, questions will be answered and our choices will follow according to the truth. Everyone wins. That’s not what happened with this “pandemic”. Not even close. Remain suspicious of liars, and maintain the use of CRITICAL thinking.

    This trial was considered “unsuccessful” because of neurological issues.

    No, they didnt kill God…What they DID do, was injected her with Animal DNA, and the blood and DNA from a murdered child…For what is abortion if its not murder? In fact, I would go so far as to call it modern day child sacrificed, with these “doctors” taking on the position of “Priests of Baal”.

A good friend linked a video to me which all but confirms that, yes, this virus IS the mark of the beast….Only the video was done in such a way with drama and theatrics, that people might not take it seriously as if views and likes were more important then the message, and when he started shrieking in a fake, preacher/prophet voice I know people are going to take the message as “conspiracy theory” rather then how deadly serious this is.

    The information in the video IS completely true. So examine the message, not the messenger…I felt that needed to be said, so people ignore the over dramatic presentation, which may even have been intentional to further drive people from the truth similar to the way the shill “Alex Jones” will tell the truth, but act so over the top that people wont believe it.

    Thats my theory on all this. And you have these used car salesmen preachers, corrupt politicians, and soulless celebrities all calling for people to “get vaccinated” for thier own good. SINCE WHEN have any of these evil men and women cared one bit about anyone but themselves?

    Alarming suicide rates, high crime, opium epidemic, inter-racial violence against whites which they pretend doesnt even exist, wars for profit that come and go, a homeless epidemic, and with all that and much more they remain silent….Only to speak up if an event might be an excuse to disarm you, and now, because they care so much about your health suddenly.

  11. Since they were developing these mRNA vaccines before the “pandemic” outbreak, whatever is in these vaccines isn’t to protect you against COVID. If it is in the best interest of the government for as many people to die of COVID as possible, why would they do anything to save your life?

    • I was also thinking about where Everyone would require a Vaccine. If for instance, some have the vaccine, then they would become immune. The rest who choose would then either contract the disease and die, or become immune through Heard immunity. Either way, the vaccine would protect you from someone who is sick or not vaccinated , AM I RIGHT?

Some states are now demanding that all children must be vaccinated for COVID before they can return to school — and many states have tried to end all exemptions, religious and philosophical, for these vaccines. But this news, that mRNA vaccines are not vaccines in a legal sense, will be used to challenge mandatory vaccination rules all over America, and hopefully many young lives will be saved.

    It isn’t the governments forcing this vaccination, and it’s not the pharmaceutical companies. It’s a power above both of those. We know who that is, and most dare not speak their name for fear of them. The Jews, says the Gospel of John (7:13). The first step in defeating them is turning off your televisions, the main instrument of their control over you. Turn it off.

  13. Again, as I’ve stated before on this site, you are not legally obliged to do anything you don’t want to do.
    It’s that simple.
    Legality is contract law. The language of legality is legalese. And in order for any contract to be legally binding, all 4 elements of that contract must be adhered to, or else the contract is invalid.
    Again, contract law (legality) IS NOT common law. It’s legislation (acts, bills, statutes). And what you’ll actually find is that pretty much 99.999% of all contracts, created, are invalid.
    Why?
    Simply because FULL DISCLOSURE was not given, more so, no contract was ever created. That is, the individual creating the contract, never actually, specifically stated that A CONTRACT WAS BEING CREATED! Deceit was carried out, as is the very nature of legality – an agenda to steal as much cash from people as the individual/state possibly can, before they realise what’s actually going on.
    A government only has authority over someone, who consents to being under their authority. No government, through the use of their goons, can impose authority either, that is lawfully and all authority that has been imposed, of late, with the covid lie, has been 100% unlawful and this is why they WILL NOT stop until they’ve finished their agenda.
    Why?
    Because THEY BLOODY WELL KNOW that the minute they fail, they end up behind bars, awaiting trial for treason and most certain life imprisonment or execution. And we’re talking thousands of people within government, the police, the judiciary, the msm, academia, health services, pharmaceutical companies, corporations, armed forces and all others responsible for promoting this lie.
    DO NOT expect to win against them in any court of law. Well, that is not unless you set up common law courts, across the land and YOUR OWN police force, who will arrest and imprison all the aforementioned peoples.
    You all have to start looking at this realistically.
    You need to understand WHO your enemy is and when you do, you go after them.
    You need to FORGET about the police, forget about the armed forces and forget about the judiciary. ALL are involved in this as well and when the armed forces are called to crush the people, they will. That’s their job.
